Military ensnared in Colombia Secret Service scandal

CARTAGENA, Colombia — Five U.S. military members have been ordered confined to quarters over possible involvement in inappropriate conduct at the same hotel here as the 11 Secret Service agents sent home in an unfolding scandal involving local prostitutes.
Making the announcement Saturday, United States Southern Command commander Gen. Douglas Fraser said he is “disappointed by the entire incident and that this behavior is not in keeping with the professional standards expected of members of the United States military.”

I don’t have a lot to add to the exchange between Einer Elhauge and Randy Barnett on the 1790s laws that Prof. Elhauge identifies as “mandates” that are sufficiently akin to the individual health insurance mandate. But I did want to say something about a particular example Prof. Elhauge gives,
[I]n 1798, Congress addressed the problem that the employer mandate to buy medical insurance for seamen covered drugs and physician services but not hospital stays. And you know what this Congress, with five framers serving in it, did? It enacted a federal law requiring the seamen to buy hospital insurance for themselves. That’s right, Congress enacted an individual mandate requiring the purchase of health insurance. And this act was signed by another founder, President John Adams
As David Kopel noted two years ago, this law (which I quote below) actually looks a lot like a payroll tax, earmarked for health care, not a mandate to buy health insurance. Ship owners were required to pay a flat sum to the government for each sailor, which they could deduct from the sailor’s wages, and the money would go to fund a local hospital for injured and disabled sailors. But nothing in the statute suggested — as would be the case with a requirement to buy insurance — that the sailor must present some proof of payment when he shows up at a hospital, or that the sailor would be penalized for refusing to pay. (A ship owner could be fined for refusing to pay the money, but that sounds like a normal fine for nonpayment of a tax.)

ST. LOUIS, Mo. (KMOX) – As St. Louis prepares to welcome tens of thousands of gun enthusiasts, you might be surprised who the NRA says is their largest growing demographic.
It’s women. And a recent survey by the National Shooting Sports Foundation found 61 percent of retailers saw an increase of female customers from 2009 to 2010.
Karl Schoenbeck owns On Target, a gun shop and shooting range in Valley Park, Mo. He says part of the increase is due to women who are learning to defend themselves with fire arms.
“We’re running concealed carry classes to teach women how to carry on the street,” said Schoenbeck.
Starting May 1st, On Target is offering woman’s only night at the range.
The St. Louis Convention and Visitors Bureau says that with more than 60,000 people are expected to attend the NRA convention this weekend. No doubt nearly half will be women.

Zimmerman Bail Hearing April 20, Case May Be Thrown Out Before Trial
Excerpted from ABC News: George Zimmerman’s attorney has begun what could be a lengthy legal battle to free his client from the second-degree murder charge filed in the case.
The first step for Zimmerman attorney Mark O’Mara will be to try to get his client out of jail while the legal process continues. A hearing for the 28-year-old probably will be held on April 20 to determine if he will be allowed to post bail and leave jail, O’Mara said late Thursday.
Earlier Thursday, Zimmerman stood straight and held his shaved head high during a four-minute hearing at a jailhouse courtroom while prosecutors briefly outlined their murder case in court papers.
O’Mara said his client’s appearance and demeanor belies what he is going through.
“He is tired. He has gone through some tribulations,” said O’Mara after the court appearance. “He is facing second-degree murder charges now. He is frightened. That would frighten any of us.”
Zimmerman did not enter a plea during the hearing, although O’Mara previously said his client ultimately will plead not guilty. Zimmerman will be able to enter a plea during his May 29 arraignment.
At some point soon, O’Mara also is expected to ask the judge for a hearing on Florida’s “stand your ground” self-defense law, which gives people a broad right to use deadly force without having to retreat from a fight.
“It is going to be a facet of this defense, I’m sure,” he said in an interview. “That statute has some troublesome portions to it, and we’re now going to have some conversations and discussions about it as a state. But right now it is the law of Florida and it is the law that is going to have an impact on this case.”
For all the relief among civil rights activists over the arrest, legal experts warned there is a real chance the case could get thrown out before it ever goes to trial because of the “stand your ground” law.
At a pretrial hearing, Zimmerman’s lawyers would only have to prove by a preponderance of evidence — a relatively low legal standard — that he acted in self-defense in order to get a judge to toss out the second-murder charges. And if that fails and the case does go to trial, the defense can raise the argument all over again.
There’s a “high likelihood it could be dismissed by the judge even before the jury gets to hear the case,” Florida defense attorney Richard Hornsby said. Karin Moore, an assistant professor of law at Florida A&M University, said the law “puts a tremendous burden on the state to prove that it wasn’t self-defense.”
To prove second-degree murder, prosecutors must show Zimmerman committed an “imminently dangerous” act that showed a “depraved” lack of regard for human life. The charge carries a mandatory sentence of 25 years in prison and a maximum of life.

State Attorney Angela Corey announced to the media Tuesday night that she will hold a press conference sometime within the next three days.
In a memo from her office, Corey said she will release new information regarding the Trayvon Martin shooting death investigation.
The media will be notified three hours in advance of the news conference, as to when and where it will be held. It will be in either Jacksonville or Sanford.

This is one of the loan agreements that Trinity United Church used to purchase the home for Rev. Wright. In addition to a $1.6 million mortgage, the agreement also attached a $10 million line-of-credit. As a non-profit entity, Trinity United did not have to report any of these financial dealings to the IRS, according to an April 2008 Fox News report. He attacks wealthy whites and great individuals of our nation, but look at the neighborhood he lives in.

The Left, the Media and Plans to Destroy Scott Walker

Labor union bosses, trial lawyers and the Wisconsin Democrats have been out to end the political career of Governor Scott Walker since the moment he took office. His move to reform government employee union collective bargaining rights was a public relations spark that ignited a partisan heap of half-truths and electoral grudges. To date, Scott Walker and his reforms are still standing (and working!) in Wisconsin much to the chagrin of the Left.
Leading up to the June recall election in which Walker will defend his governorship, Democrats and Big Labor aren’t talking about collective bargaining reforms. According to an internal Democrat Party of Wisconsin memo reported on by Mother Jones magazine, Wisconsin Democrats are hoping to oust Walker by in part focusing heavily on what is known as the John Doe investigation.
In Wisconsin, prosecutors may launch secretive probes (hence the name “John Doe”) into criminal activities. John Chisholm, the Democrat District Attorney for Milwaukee County, has for 2 years now been running a John Doe investigation into former county government employees who held jobs while Walker was Milwaukee County Executive.
Interestingly enough, it was Walker who called for the probe to out suspected fraud.
After Walker took office as governor, Democrats began hinting that the John Doe would morph into a probe of Walker, and thus Walker could become Wisconsin’s own version of Richard Nixon. The first Democrat Party of Wisconsin television ad of the gubernatorial recall explicitly made the Walker-Nixon comparison.
Uncanny leaks about the activities of investigators have found their way onto the front page of the Milwaukee Journal Sentinel. The paper, struggling to stay afloat financially, has prided itself on being skeptical of Walker and on having exclusive access to a string of insider information about the John Doe probe. It appears as if the integrity of the probe, led by a Democrat District Attorney, is compromised by the partisan nature of the leaks.
Wisconsin state law prohibits individuals with knowledge of a John Doe investigation from talking about it to anyone, including the media.
Just how partisan the Milwaukee County District Attorney’s office is was revealed on Monday when Media Trackers confirmed that no less than 43 attorneys and staff members in the prosecutor’s office signed Walker recall petitions. More officials in the office may have signed, and the total number of matching names from the staff roster and names on recall petitions reaches as high as 70, though full confirmation of that number is still underway.
The partisanship reached to the highest levels, with one Lovell Johnson, Jr. a Deputy District Attorney who reports directly to elected Democrat DA John Chisholm.
Perhaps most interesting of all is the signature of Janet Oelstrom. Oelstrom is not an attorney, but she does work as a secretary in the tightly controlled and elite Public Integrity Unit, which oversees all John Doe investigations into public officials. As secretary, Oelstrom has access to a tremendous amount of information (all of it valuable to political opponents) including the John Doe probe into Walker’s county executive staff.
The presence of such a partisan individual handling sensitive information that could be used to inaccurately disparage a political opponent is troubling to say the least. That between 15% – 25% of the staff of the office running a probe speculated by Democrats to be aimed at Walker have such a partisan view of him calls into question their ability to professionally handle this case.
Oddly, the Milwaukee Journal Sentinel, which normally holds itself up as a watchdog against abuse of government office, has chosen to bury this story and ignore it as much as possible. Could it be that the liberal reporters and editors at the newspaper are providing cover for what increasingly looks like a politically motivated investigation into a conservative governor?
Let’s get this straight: Democrats in Wisconsin want to take Walker out by relying on the information they glean from this supposed-to-be-secret investigation. A Democrat District Attorney is leading this investigation and a tremendous number of his staff signed petitions to remove Governor Walker from office. The newspaper that gets all the well-placed leaks and tends to spin the story to favor liberals and Democrats is silent about this expose of partisanship and bias.
This looks like a classic case of a liberal media establishment, a far-left political party, and a highly partisan set of public officials trying to get away with destroying a conservative political opponent. If this is what it is, let’s hope it fails and kudos to the guys at Media Trackers who discovered the bias, partisanship, and horrible conflict of interest.

White House has diverted $500M to IRS to implement healthcare law
The Obama administration is quietly diverting roughly $500 million to the IRS to help implement the president’s healthcare law.
The money is only part of the IRS’s total implementation spending, and it is being provided outside the normal appropriations process. The tax agency is responsible for several key provisions of the new law, including the unpopular individual mandate.
Republican lawmakers have tried to cut off funding to implement the healthcare law, at least until after the Supreme Court decides whether to strike it down. That ruling is expected by June, and oral arguments last week indicated the justices might well overturn at least the individual mandate, if not the whole law.
“While President Obama and his Senate allies continue to spend more tax dollars implementing an unpopular and unworkable law that may very well be struck down as unconstitutional in a matter of months, I’ll continue to stand with the American people who want to repeal this law and replace it with something that will actually address the cost of healthcare,” said Rep. Denny Rehberg (R-Mont.), who chairs the House Appropriations subcommittee for healthcare and is in a closely contested Senate race this year.

It has moved aggressively to get important policies in place. And, according to a review of budget documents and figures provided by congressional staff, the administration is also burning through implementation funding provided in the healthcare law.

Zimmerman family challenges Holder on New Black Panthers, says no arrests ‘based solely on your race’
In a letter to Attorney General Eric Holder on Monday, obtained exclusively by The Daily Caller, a family member of George Zimmerman asked the nation’s top law enforcement officer why he has chosen to not arrest members of the New Black Panther Party for their rhetoric — some of which may fit the federal government’s definition of a hate crime — throughout the Trayvon Martin case.
The family member believes the reason Holder hasn’t made those arrests is because he, like the members of the New Black Panther Party, is black.
“I am writing you to ask you why, when the law of the land is crystal clear, is your office not arresting the New Black Panthers for hate crimes?” the family member wrote to Holder.
